THIS INDENTURE made the eight day of January in the year of our Lord one thousand seven hundred and sixty three between Henry Mohler Senr. of Cocalico township Lancaster County and province of Pennsylvania and Elizabeth his wife of the one part and Henry Moller Junior one of the sons of the said Henry Moller Senr of the said township Cocalico and in the said County and province aforesaid yeoman of the other part whereas John Penn Thomas Penn and Richard Penn Esquires true and absolute propertaries of the said province by a certain patent under the hand of the said Thomas Penn and their great seal bearing date the twelfth day of June Anno Domini one thousand seven hundred and thirty four for the considerations therein mentioned dith with other land grant and confirm unto one John White a merchant in the city of Philadelphia in right of a certain grant made by the late proprietary William Penn Esquire unto James Joseph and Benjamin Crispen Jane Elenor Elizabeth and Amy Crispin the children of Capt. William Crispin late of King sale in Ireland deceased by deed dated the eight day of August Anno Domini 1687 now west and in the said John White a certain tract of land situate in the said county of Lancaster containing one thousand six hundred and fourty seven acres and allowance to hold to him the said John White his heirs and assigns forever paying therefore yearly two shillings sterling or the value for every hundred acres thereof as by the said patent recorded in the office for recording of deeds for the city and county of Philadelphia in patent book A. Vol. 6 page 348 &c the second day of June 1734 and whereas the said John White by his certain deeds or indentures of lease and release bearing date the eighteenth and nineteenth days of November anno domini one thousand seven hundred and thirty six dith grant bargain and sell release and confirm unto the said Henry Moller Senr. and to his heirs and assigns forever apart of the above mentioned tract of land for the consideration therein mentioned allso by the bounds and line in the said deed mentioned containing two hundred and forty five acres and the usual allowance of six persent of roads &ca as may more fully appear by the said writing indentures now this indenture witnesseth that the said Henry Moller Senr. and Elizabeth his wife as well for the love and natural affection that they retain for their said son Henry Moller Junr. as also for the consideration of the sum of twenty shillings lawful money of the said province to them in hand well and truly paid before the ensealing and delivery of these presents the receipt and payment whereof is hereby acknowledged the said Henry Moller Senr. and Elizabeth his wife therewith fully content and paid and the said Henry Moller Junr. his heirs executors administrators and assigns and every thereof acquit and discharge forever have granted bargained and sold aliened remised released enfeoffed and confirmed and by these presents they and each of them do give grant bargain sell allien remise release enfeoff and confirm unto him the said Henry Moller Junr. and to his heirs and assigns a certain part or parcel of the above mentioned tract of land beginning at a post set op for a corner by the land of Michael Andreas and by the said south east by south forty perches to a chestnut tree marked for a corner and thence by other land of the said Henry Moller Junr. and by the said east by south one hundred and seventy three perches to a black oak marked for a corner and thence by the said north forty degrees east ninty six perches to a stone corner and thence by the land of Jacob Groff and by the said north eighteen degrees west thirty eight perches to a post set op for a corner and thence by the land of Jacob Moller being of the said tract and extending by the said south eighty degrees west two hundred and fourty six perches to the place of beginning containing ninty five acres and the allowance of six acres per cent for roads and highways &ca being part of the said tract of two hundred forty five acres above mentioned together with all the woods meadows ways waters watercourses rights liberties priviledges buildings improvements hereditaments and appurtenances whatsoever to the said piece or parcel of land and premises hereby granted belonging or in anywise appertaining and the reversions and remainders rents issues and profits thereof and all the estate and interest whatsoever of him the said Henry Moller Senr. of in and to the hereby granted premises and true copies of all deeds evidences and writings concerning the same to be had and taken at the charge of the said Henry Moller Junr. his heirs and assigns to have and to hold the said described piece or parcel of land hereditaments and premises hereby granted and released or mentioned so to be and every part thereof with the appurtenances unto the said Henry Moller Junr. and to his heirs to the only use of him the said Henry Moller Junr his heirs and assigns forever under the proportionable part of the yearly quit rent aforesaid hereafter accruing for the same to the chief Lord or Lords of the fee thereof and the said Henry Moler Senr and Elizabeth his wife the said described piece or parcel of land and premises hereby granted and released or mentioned to be granted and every part thereof with the appurtenances unto the said Henry Moller Junr. his heirs and assigns against him the said Henry Moller and his other heirs and against all and every other person and persons whatsoever lawfully claiming or to claim the hereby granted premises shall and will warrant and forever defend by these presents and the said Henry Moller Senr. and Elizabeth his said wife for themselves and their other heirs executors and administrators doth covenant promise and grant to and with the said Henry Moller Junr his heirs and assigns by these presents that the said Henry Moller Senr. and his other heirs and all and every other person and persons whatsoever having or lawfully claiming or that shall or may at any time or times hereafter so have or claim any estate right title or interest of in or to the hereby granted premises or any part thereof by from or under him them or any of them shall and will at any time or times hereafter upon the reasonable request costs and charges in law of the said Henry Moller Junr. his heirs or assigns make execute and acknowledge or cause so to be all and every such further and other reasonable act and acts deed or deeds devise or devices in law whatsoever for the further and better assurance and confirmation of the said described piece or parcel of land hereditaments and premises hereby granted and released or mentioned so to be and of every or any part thereof with the appurtenances unto the said Henry Moller Junr. his heirs and assigns as by him or them or by his or their council learned in the law shall be reasonably devised or required and that he the said Henry Moller is the sole and lawful owner and proprietor of the said land and premises hereby granted and is seized thereof in his own right as of a good and indefeazible estate in fee simple without any condition limitation or other clause matter or things to alter change defeat or make void the same and that he the said Henry Moller Senr now hath a good right full power lawfull and absolute authority to grant and convey the the said ninty five acres of land with their appurtenances unto his said son Henry Moller Junr. and his heirs and assigns forever in menner aforesaid and that the said granted premises with the appurtenances are now and from henceforth forever hereafter shall remain and continue unto the said Henry Moller Junr. his heirs and assigns free and clear and freely and clearly acquitted and discharged and from all and all menner of former and other bargains sales gifts grants rights titles estates claims and demands arrages of rents and other incumbrances whatsoever in witness whereof the said parties to these presents have interchangeably put their hands and seals hereunto dated the day and year first above written. The fifth day of April in the year of our Lord one thousand seven hundred and six three personally appeared before me Emanuel Carpenter Esquire one of his majesties justices of the peace for the county of Lancaster the above named Henry Moller Senr. and Elizabeth his wife and acknowledged the above indenture to be their act and deed and desired the same might be recorded as such according to law the said wife being voluntarily consenting thereto the above contents being first made known unto her witness my hand and seal dated by day and year first above written.
