THIS INDENTURE, Made the twelfth Day of October in the year of Our Lord one thousand seven hundred & Seventy Six BETWEEN John Landis the surviving Executor of the Last Will and Testament of Henry Mohler (the elder) late of Cocalico Township in the County of Lancaster and Province of Pennsylvania Yeoman deceased of the one part, and John Mohler one of the Sons of the said Henry Mohler deceased of the other part.

WHEREAS, John Penn, Thomas Penn and Richard Penn Esquires true and absolute Proprietaries of the said Province by a certain Patent under the Hand of the said Thomas Penn, and their great seal bearing date the twelfth Day of June Anno Domini One thousand Seven hundred & thirty four for the Considerations therein mentioned did (with other land) grant and confirm unto John White Merchant (in right of a certain grant made by the late Proprietary William Penn Esqr. Unto James Joseph and Benjamin Crispin, Jane, Eleanor, Elizabeth and Amy Crispin the Children of Capt. William Crispin late of King sale in Ireland deceased by Deed dated the eighth Day of August one thousand Six hundred and eighty Seven, and then vested in the said John White a certain Tract of Land situate in Cocalico Township and County of Lancaster aforesaid, containing One thousand six hundred and forty seven Acres and the usual allowance of Six P.cent for Roads and highways as by the said Patent recorded in the office for the recording of Deeds for the City and County of Philadelphia in Patent Book A, Vol. 6, Page 349. &ca., the second day of July one thousand seven hundred and thirty four relation being thereunto had may more fully appear.

AND WHEREAS, The said John White by his Indenture bearing date the nineteenth Day of November Anno Domini one thousand Seven hundred and thirty Six for the Consideration therein mentioned did grant bargain and Sell unto Sigismond Landert his Heirs and Assigns a certain piece and parcel of the above mentioned Tract of one thousand Six hundred and forty seven acres and allowance aforesaid as by the Courses and distances in the said Indenture specified containing one hundred and forty acres and the allowance aforesaid relation thereunto being had may more fully appear.

AND WHREAS, The said Sigismond Landert by his Indenture bearing date the Fifteenth Day of October in the Year of Our Lord one thousand seven hundred & forty four for the Consideration therein mentioned did grant bargain sell release and confirm unto Christian Graff his Heirs and Assigns All that the above mentioned Tract of One hundred and forty Acres & the allowance aforesaid with the Rights Members and Appurtenances thereof relation being thereunto had may more fully appear.

AND WHEREAS, The said Christian Graff was in his Life Time by Virtue of the said last recited Indenture seized in his demesne, as of fee of and in the said Tract of Land containing one hundred and forty Acres and the allowance aforesaid and died so thereof seized intestate leaving his Widow Margret Graff and issue five Children, to wit Jacob Graff his eldest son and Heir at comon Law, Abraham Graff, Margret who intermarried with Adam Rutter, Elizabeth who intermarried with Henry Heiple and Barbara Graff to and amongst whom the said Tract of Land descended and came agreeable to the Laws of the said Province of Pennsylvania.

AND WHEREAS, The said Margret Graff the Widow Jacob Graff & Margret his Wife Abraham Graff Adam Rutter and Margret his Wife Henry Heiple and Elizabeth his Wife and Barbara Graff by their Indenture bearing date the thirteenth Day of May I the Year of Our Lord one thousand seven hundred and fifty two for the Consideration therein mentioned did grant bargain sell release and confirm unto the said Henry Mohler (the elder) deceased his Heirs and Assigns ALL THAT the above mentioned Tract of Land containing one hundred and forty acres and the allowance aforesaid with the appurtenances thereof relation being thereunto had may more fully appear.

AND WHEREAS, The said Henry Mohler (the elder) was in his life Time by Virtue of the last recited Indenture seized in his demesne as of fee of and in the said Tract of Land containing one hundred and forty acres and the allowance, with the appurtenances and died so thereof seized having first made his last Will and Testament in writing bearing date the twenty second day of August in the Year of Our Lord one thousand seven hundred and Sixty nine (duly proved and remaining in the Registers Office at Lancaster) wherein and whereby the said Testator ordained that his Son the said John should have (among other Land) the Plantation whereon the said Testator then lived meaning the above mentioned Tract of Land (excepting a Piece of Forty acres thereof which he gave to his Son Martin Mohler by his said last Will and Testament) and in and by the said last Will and Testament did nominate & appoint the said John Landis and his Son Henry Mohler (who is since deceased) Executors of that his last will impowering them or the survivor of them to grant and make goods Deeds to his Sons for their respective Shares of Land given to them by his last Will which Deeds he acknowledged to be lawful relation to the said Patent, several recited Indentures and last Will and Testament being respectively had may more fully and at large appear.

NOW THIS INDENTURE WITNESSETH, That the said John Landes for and in Consideration of the Sum of Two hundred and fifty five pounds lawful Money of Pennsylvania to him the said John Landis in hand well and truly paid by the said John Mohler at and before the Sealing and delivery of these presents the receipt and payment whereof he the said John Landis doth hereby acknowledge and thereof and of every part and parcel thereof doth exonerate acquit release and forever discharge the said John Mohler his Heirs and Assigns by these presents HATH granted bargained sold aliened enfeoffed released and confirmed and by these presents and by force and Virtue of the said Last Will and Testament and by the Authority of the same DOTH grant bargain sell alien enfeoff release and confirm unto the said John Mohler his Heirs and Assigns forever.

ALL THAT CERTAIN Piece parcel or Tract of Land situate in the said Township of Cocalico and County and Province aforesaid, bounded and described by the Lines as follows, to wit, BEGINNING at a Post corner, thence by Land late of Jacob Hershberger deceased South Forty Degrees East one hundred and Seventy Perches to a Hickory, thence by the same South twenty two Degrees East, one hundred and twenty Perches to a Hickory corner by Cocalico Creek, thence down the same on the several courses thereof One hundred and thirty Perches to a hickory corner, thence by Land of Jacob Mohler, South fifty two Degrees West thirty Perches to a hickory corner, thence by Land of John Heffly North forty Degrees West, Twenty five Perches to a Post, thence by Land of Martin Mohler North twenty seven Degrees West three hundred & Sixty Perches and an half Perch to a Post Corner, thence by Land of Adam Bower East by North, thirty four Perches and an half Perch to the Place of BEGINNING. CONTAINING One hundred Acres and the allowance of Six P.cent for roads and Highway, being part and parcel of the above mentioned Tract of One hundred and forty Acres & allowance aforesaid.

TOGETHER with all and singular the buildings and Improvements thereon errected & built and all ways Woods, Waters, Watercourses, Rights, Members Priviledges Hereditaments and Appurtenances whatsoever to the said described Tract of Land belonging or in anywise appertaining and the Reversion and Reversions remainder and remainders rents issues and profits thereof, AND also all the Estate right Title Interest Property Possession Claim and Demand whatsoever both at Law and in Equity of him the said Henry Mohler (the elder) at and immediately before the time of his decease of in and to the same and every part & parcel thereof Together also with all Deeds Evidences and writings touching or concerning the same.

TO HAVE AND TO HOLD, The above described Tract of Land containing one hundred acres and the allowance aforesaid, be it the same more or less Hereditaments and premisses hereby granted and released, or mentioned or intended so to be, with the appurtenances, unto the said John Mohler his Heirs and Assigns to the only proper Use and Behooff of him the said John Mohler his Heirs and Assigns forever.

AT AND UNDER the proportionable part of the Yearly Quitrent thereon due and hereafter to become due & payable for the same to the chief Lord or Lords of the fee thereof.

AND, The said John Landis for himself and his Heirs and Executors and Administrators doth covenant promise and grant to and with the said John Mohler his Heirs and Assigns by these presents, that he hath not wittingly or willingly done or suffered any act matter or thing whereby the said One hundred Acres & allowance of Land more or less Hereditaments & Premisses hereby granted or released, or mentioned or intended so to be) with the appurtenances, is or may be impeached or incumbred in Title charge or otherwise howsoever.

LANCASTER COUNTY SS; Before me the subscriber one of the Justices of the County of comon pleas in and for the said County of Lancaster, personally came and appeared the above named John Landis the grantor & acknowledged the above written Indenture to be his Act and Deed and desired that the same might be recorded as such, according to Law IN TESTIMONY WHEREOF, I have hereunto set my Hand and Seal the twelfth Day of October in the Year of our Lord one thousand Seven hundred and Seventy Six.
